We
…………………………………………………………. Having our office / factory at ……………………
………………………………………………………… up do hereby undertake to comply with your
following requirements in order that you may effect delivery of the
container to us as aforesaid.
1.
Container shall be
deemed to have been delivered to us in sound condition unless we bring to
your notice the damage if any to the container before taking delivery from
the port for de-stuffing at our premises. We hereby agree and undertake to
return the container in sound condition at the site nominated by
you.
2.
We hereby agree and
undertake to inform you as soon as the container is required by us at the
nominated site and if any event within 12 hours from the time the said
container is returned at nominated place damages caused to the container
if any, the finding of your surveyor in regard to cost repair work,
damages to the container shall be agree and undertake to pay you such cum
as may be recommended by your surveyor forthwith.
3.
We hereby undertake
to indemnify you against all claims, cost charges, expenses and/or any
liability whatsoever from any persons in the event of any injury and / or
death caused to any person rising out of the use, operation or possession
of container by us or our agent or our servants and / or representatives,
the container should be deemed to be under our control until the expiry of
24 hours from the time. We give written intimation of the delivery of the
container by us at our nominated site.
4.
We will be liable
for container detention after the first 5 free days (time to commence at
8.00 A.M.
) The day following
date of which the container has been loaded in
Delhi
if the detention charges
as follows in Indian Currency, converted at the rate of exchange
prevailing the relevant time.
UP TO 1st WEEK
20` USD 08.50 40` USD 17.00
UP TO 2nd WEEK
20` USD 13.50 40` USD 27.00
UP TO 3rd WEEK
20` USD 17.50 40` USD 35.00
THEREAFTER PER
DAY 20` USD 48.00 40` USD 96.00
If any event, we
hereby agree and undertake to return the container at your nominated site
within 30 days from the date of delivery.
Further, we agree
and undertaken to furnish to you within one week of the return of the
container at your nominated site. The documents endorsed by Delhi Customs
show in the dates the container was removed from and returned to your
nominated site.
