We wish to move the above mentioned loaded containers to our plant at …………………………………. For destuffing of our import consignment arrived per M.V. ……………………………… under your agency. We hereby undertake to comply with your following requirements in order that you may effect delivery of the container to us as aforesaid:
- (1) The container/s shall be deemed to have been delivered to us sound condition unless we bring to your notice the damage, if any, to the containers before taking delivery from the port for destuffing at our premises. We hereby agree and undertake to return the container/s in sound conditions at the site nominated by you.
- (2) We hereby agree and undertake to inform you as soon as the container/s are returned by us at the nominated site and in any event within 12 hours from the time the said container/s is/are returned at the nominated place. Within 24 hrs of the receipt of the said information you should carry out survey of the damages caused to the container/s, if any. The findings of your survey or in regard to cist, repair work, damages to the container/s shall be final and binding on us. On receipt of the said report we hereby agree and undertake to pay you such sum as may be recommended by our surveyor forthwith.
- (3) We hereby agree and undertake to indemnify you against all claims, costs, charges, expenses and / or death caused to any person/s and /or damage caused to the property and accident to any person/s arising out of the use, operation or possession of container/s by us or our representative/s. The container/s should be deemed to be under our control until the expiry of 24 hrs from the time we give written intimation of the delivery of the container/s by us at your nominated site.
- (4) We will be liable fro container detention after the first 5 free days. If the container/s is / are not received by you within the period allowed, we will be liable for container detention charges as follows in Indian currency, converted at the rate of exchange prevailing at relevant time.
US$ 08.50 per calendar day or part thereof per TEU for first 7 days
US$ 13.50 per calendar day or part thereof per TEU for next 7 days
US$ 17.50 per calendar day or part thereof per TEU for next 7 days
US$ 48.00 per calendar day or part thereof per TEU for thereafter
In any event, we hereby agree and undertake to return the container/s at your nominated site within 30 days from the date of delivery.
Further, we agree and undertake to furnish to you one week of the return of the container/s at your nominated site, the documents endorsed by Delhi customs show in the dates the container/was/were removed from and returned to your nominated site.
In case of any damages to the container/s, we hereby, undertake to make the payment in demand draft within 7 days on receipt of your demand/debit note and as per your yard estimates. Failing which we undertake to pay all detention charges till repair of the container on receipt of the full damage charges.
