We confirm that the consignee’s and the owner’s of the cargo into this above mentioned containers and which have arrived per vessel …………………… Voy ………. under your agency. In consideration of your permitting us to move the containers to our factory premised at ………………………………………………………………………… 

1] We hereby agree & undertake to bring to your notice in writing the damage if any to the containers prior to our taking delivery of same from Tughlakabad / Patparganj / Faridabad / Ballabgarh for moving at our cost to our aforesaid premises for de-stuffing in absence of any written notice of any damage to the containers, the container shall deemed to have been delivered to us good order and sound condition.

2] We hereby undertake to return the aforesaid containers in good order and sound condition at a site nominated by you, otherwise we are ready to give you the transportation charges for to your desired location / site.

3] We hereby agree and undertake to pay you on demand the amount in respect of any loss / damage sustained by the commissioner, in this connection your surveyors reports certifying the loss / damage as well as the amount of loss determined by them shall be final and binding on us, even though we may not have been present at the time of survey.

4] We hereby agree and undertake to de-stuff the aforesaid containers immediately and return them expeditiously to you at our cost at the nominated site. 

5] We hereby agree and undertake not to withhold your aforesaid containers beyond reasonable time and in any event nor more than 15 days from the date to taking delivery of the same from the purpose of de-stuffing at our aforesaid premises.

6] We hereby agree and confirm that we are liable to pay you on demand not only for loss or damage sustained by the container but also for customs penalties of applied and the container detention charges on expiry of first 05 free days beginning for the date which the container have landed at Tughlakabad / Patparganj / Faridabad / Ballabgarh, the current container detention charges are as under:-

For next Seven days                                         US $ 13.50                   US$ 27.00

For next Seven days                                         US $ 17.50                   US$ 35.00

7] We also hereby agree and confirm to pay other related costs / expenses including custom fines penalties if any.

8] We hereby agree and undertake to deposit such amount and / or furnish security for such amount that you may calculate to be payable by us either for value of the containers and / or towards the containers detention charges.

9] We hereby agree and undertake to indemnify you against all third party’s claims, costs, charges, expenses and / or liability whatsoever in the event of any loss or damage caused to the property of any person and / or in the event of any injury possession of your aforesaid containers by us and / or servant up to our having taking delivery of the containers from Tughlakabad / Patparganj / Faridabad / Ballabgarh until expiry of 24 hours from the time return to you at the site from where it was taken delivery for the site nominated by you.

10] We hereby agree and undertake to give you a written intimation of the return of the container as soon as possible and in any event nor later than 12 hours after returning the above containers at the site from where they were taking delivery or at the nominated by you.

11] We hereby agree and undertake to furnish you the documents bearing the endorsement of the custom authorities showing the date on which the container were return by to you to Tughlakabad / Patparganj / Faridabad / Ballabgarh and or the site nominated by you, within one week from the date of return of the containers at the above referred places.
