Whereas for the purpose of destuffing the goods, it is necessary to take the container(s) out of ICD, New Delhi to our premises at    …………………………….……………………………………………………

 Whereas for the purpose of removal M/s Goodrich Maritime Pvt. Ltd. The agents of the shipping company have executed an indemnity bond in favour of customs deptt. to ensure return of the containers in the docks and for the purpose of indemnifying against possible loss or damage to the said containers due to whatsoever reasons, force majeure, negligence require this bond from importer/shipping/agents.

Now therefore in consideration of our executing the necessary bond aforesaid to enable us to move the containers out of ICD, New Delhi for the purpose of destuffing the same in our premises at ……………………………………………………………………… . We agree and undertake for purposes and our successors and cost of assigns indemnified against all claims losses demands damages and cost of any against we hereby agree and confirm to abide by the following terms and conditions :-

1          The importer and /or Clearing Agents contractors/ Transporters/ above here named and /or their employees servants shall take all responsibilities care to ensure that the above named containers are kept in suitable condition for all whose acts of omissions and commissions the shipper is solely liable.

2          The importer agrees to indemnify the carrier and or their agents above named against all the loss damages liability cost of expenditure suffered or incurred during the movement of containers or while in possession custody or exporter/shipper or arising out

of connected with injury death or person or in the process of such movement and destuffing operation.

3          The importer or their agent shall return containers in a good sound condition and for this purpose would be conducted by your authorized surveyor and their report and their findings shall be binding on the importer/agents.

4          The importer agent are liable to indemnify the carrier or its agents for claim to the customs and or indemnify any loss suffered by the carrier due to physical damage or loss to the container while in custody of shipper/importer to the extent of Rs.200000/- Rs Two Lacs Only) for each 20 ft container and Rs.400000/- (Rs. Four Lacs Only) for 40 ft containers.

5          The guarantee under these presents shall be effective from the containers are delivered to the importer agent or their representative till the same is returned to the ICD, New Delhi, delivery against clear receipt and discharge.

The importer /agent agree to return the all containers in good order and condition to the ICD, New Delhi within a period of 5 days. The importer agent is liable to pay detention charges at the Karmohem Conference prescribed rates till the containers are returned to ICD, New Delhi .
