Whereas for the purpose of de-stuffing of the goods, it is necessary to remove the container’s out of  ICD, Delhi to our premises at ………………………………………….................

Whereas for the purpose of physical removal of the container, M/s …………….., are required to execute and indemnity bond in favour of Delhi customs to ensure return of the container in the docks and for the purpose of indemnifying against possible loss or damage to the said container’s due to what so ever reason force major negligence or otherwise require this bond from EXPORTERS/CONSIGNEE/AGENTS.

Now therefore in consideration of your executing the necessary bond aforesaid, enable us to move the container’s out of the ICD, New Delhi area for the purpose of the de-stuffing the same in our factory located at ………………………………………………………….

We/I agree & undertake for ourselves and our successors and assigns indemnified against all claim losses demands damages and in any capacity what so ever or sustained said indemnity bond and against, we hereby agree and cost of any nature what so ever that may be made on you any body and in any capacity what so ever or sustained indemnity bond and against we hereby agree and confirm to abide by the following terms and condition.

1)                  The importer and/or clearing agents/contractors/transporters (above name) and or their employees and servants shall take all responsibility care to that containers are kept in a suitable and good condition for all whose acts or omission and commission the consignee is solely liable.

  2)                  The importer agree to indemnify the carrier and or their agents (above mentioned) against all the losses, damages, liability, lost or expenditure suffered or incurred by the movements of the containers while in possession of importer arising out of the connected with injury or death purpose or loss or damage to property or person in the process of such movement and de-stuffing operation.

3)                  The importer shall return the container in good sound condition. For this purpose survey to be conducted by our authorized surveyors and their report and their finding shall be bidding on the importer/agent.

 
4)                  The importer / agent are liable to indemnify the carrier or its agents for the claim by the customs and or to indemnify and loss suffered by the carrier due to physical damage or loss to the container, while in custody of shipper/exporter to the extent of RS 2,50,000/- (Rs. Two Lacs Fifty Thousand Only.) for one 20` container and RS 5, 00,000/- (Rs. Five Lacs Only) for one 40` container, for reefer container case it should be 7, 00,000/20` and 10,00,000/40`.

  5)                  The guarantee under these presents shall be effective from the time containers is delivered to the importer or their respective till the same is delivered to the ICD, Delhi delivered against clear receipt and discharge.

The importer/agent agrees to return the all containers in good order and condition to the ICD, Delhi within a period of 5 days. The importer/agent is liable to pay damage and detention charges at Karmoharm conferences prescribed rates till the containers are returned to ICD, New Delhi .
