In Consideration of
your allowing the above mentioned import loaded container to our premises.
We the undersigned hereby undertake and guarantee you the
following:-
1 We
shall at our cost & risk remove the containers from nominated site
(ICD,
Tughlakabad /
Patparganj / ACTL) to our premises situated at _____________

within five days and return the same to your storage yard within three
days from the date of its removal.
2 We
shall at our cost arrange to survey the containers by your surveyors
before
removal from
nominated site and after returning at your storage yard.
3 In case
of any damages to the containers whilst in our custody. We shall pay the
repair cost of
damages as estimated by your surveyors.
4 In the
event of the importer being unable to return the empty container and
deliver
the same to the
shipping agent with in the expiry of the stipulated time in terms of this
provision of the bill of lading. They will render the them selves liable
to pay detention charges Indian Rupees equivalent to U S Dollars rate are
given below and repair cost of the containers, if any,

5) In case of
the container/s lost whilst in our custody, we shall pay you the cost of
container/s (INR
3,00,000/-) Per 20` and (INR
6,00,000/-) Per 40` container only and the customs duty applicable on the
container/s.
6) In case we
fail to return the container within one month from the date of removal, we
shall obtain necessary permission from you and custom authorities to
retain the container/s with us beyond seven days.
7) We shall keep
you and the carriers completely indemnified and harmless from and against
all consequences which may arise from your complying with our
request.
8) This bond
will remain in force till such time we comply with our undertaking and
fulfill all your/customs authorities requirements. That the bond will be
cancelled only after confirmation from the depot officer confirmed. That
the containers has/have been returned in sound condition.
9) We hereby
confirm that the import cargo does not contain contraband articles. In
term of Indian Customs regulation and that the shipper have not tampered
with container/s for the purpose of concealment of any contraband cargo in
the event of customs or any other Govt. Authorities discovering that,
there are contraband cargo loaded, then we undertake to accept all cost
and consequences arising due to the mis-declaration. We further reaffirm
that the container/s would only be taken to our premises at
____________________ and that we would approximately take three days to
return the container/s back to your empty storage yard after removal from
the ICD, Tughlakabad, Patparganj, ACTL nominated site.
