WHEREAS for the purpose of de-stuffing the goods it is necessary to move the container out of Delhi Inland Container Depot (ICD) area, you, as agents of the Shipping Company ………………………............. are required to execute an Indemnity Bond in favor of the Mumbai Customs, to ensure return of the container to ICD Delhi.
Now, therefore, in consideration of your executing the necessary aforesaid Bond to enable us to move the container our of Delhi Inland Container Depot area for the purpose of de-stuffing the same, we M/s.______________________________________________
do hereby agree and undertake for ourselves and our successors assigns to indemnify and keep you and /or your successors against all claims, losses, demands, damages & costs of any nature whatsoever that may be made on you by anybody and in any capacity or sustained or incurred by you in consequence of your having executed the said Indemnity Bond and we hereby agree and confirm to abide by the following terms and conditions:
TERMS & CONDITIONS:-
- The consignee and /or their clearing agents, container transporters and /or their employees and servants shall take all reasonable care to ensure that the container is kept in suitable and useable condition for all of whose acts of omission and commission the consignee is solely liable.
- The consignee agree to indemnify the carrier and /or the agents (above named) against any or all losses, damages, liability, costs or expenses suffered or incurred by the movement of the container while in the possession of the Consignee, arising out of or while connected with injury or death of persons or loss or damage to property or other persons in the course of such movement and de-stuffing operations.
- The consignee shall return the containers in sound condition as earlier delivered and for failure to do so, will be liable for cost of repair and damages. For this purpose survey will be done by our nominated surveyors,and their report and findings shall be binding on the consignee.
- The consignee is liable to indemnify the carrier or its agents for claim by the customs to the extent of Rs.3,00,000/- (Rupees Three Lacs only) per 20’ container and Rs. 6,00,000/- (Rupees Six Lakhs only) per 40’ container.
- The guarantee under these presents shall be effective from the time the container is delivered to the consignee or their representative till the same is returned to our nominated site and delivered against agency’s clear receipt and discharge.
- The consignee agrees to return the empty container in good condition to nominated site within a period of stipulated time frame till validation of Delivery Order.
- If the container is not received by the carrier within the period allowed above, we will be liable for detention charges as below:-

- Bond should be made on a Stamp Paper of Rs.100/-
- Signature on Bond to be duly attested from Bank on all the pages.
- Security Charge – Rs. 10,000/- per 20’ and Rs. 20,000/- per 40’ contr.(General)
25,000/-per 20’ and Rs 40,000/-per 40’cntr for Commodity Rubber Process Oil, Wax Residue, Natural Aslphalt,Stainless Steel,Scrap.
- Security to be made as Demand Draft in favour of ……………….
- Payment in terms of Cash will not be accepted in any circumstances.
- Old security deposited will not be accepted for re-use or re-validation in New Shipment /
- Security Refund Timings: 09:30 AM TO 03:00 FROM MONDAY TO FRIDAY.
